Billing and Service Policy: Recurring Marketing Services and Management Packages

Recurring services are paid in advance of the period covered, either Monthly by direct debit via GoCardless, or Quarterly by invoice. Payment is due within 14 days of invoice. Accounts are in default if payment is not received within 30 days of invoice date.

Accounts in default may have their service interrupted. Such interruption does not relieve the client from the obligation to pay the management charge. Only a written request to terminate your service relieves you of your obligation to pay the management charge. Written requests MUST BE delivered in person or by registered post. Emails and Faxes are not acceptable. Accounts in default may be subject to a late payment charge of €20 per month. If the client defaults, the client agrees to pay exSite Communications Limited its reasonable expenses, including solicitor and collection agency fees, incurred in enforcing its rights under these Terms and Conditions.

All files, information and mail under the account will be preserved for 45 days from the date the payment is due. If the payment is not received after 45 days, all files, information and mail under the account may be deleted. If the client wishes to use the service again, the client must re-apply as a new client.

The client agrees that exSite Communications Limited has the right to delete all data, files or other information that is stored in the client’s account if the client’s account with exSite Communications Limited is in default or if it is terminated, for any reason, by either exSite Communications Limited or the client.

If your bill remains unpaid, exSite Communications Limited reserve the right to claim domain names registered.

exSite Communications Limited shall have the right to suspend service to the client at any time, and for any reason, without notice. If such a suspension is to last for more than 5 days, the client will be notified as to the reason.

Hosting and domain services are provided for an initial term of 12 months and shall automatically renew for subsequent 12 month terms, until terminated. After the Initial Term, clients may terminate this agreement upon thirty (30) days written notice to exSite Communications Limited. Should the client terminate this agreement for any reason during the initial term, a cancellation fee equal to three (3) months monthly service fee will become immediately due, and client acknowledges and agrees to pay such fee. exSite Communications Limited may in its sole discretion terminate the Service at any time. In the event that exSite Communications Limited terminates the Service for reasons other than breach of this Agreement by the client, then exSite Communications Limited shall endeavour to, to the extent reasonably possible, provide 30 days notice to the client. The client is liable under this Agreement for all fees and charges until such time as the Agreement has been terminated.

THE CLIENT UNDERSTANDS THAT UNLESS WRITTEN NOTIFICATION IS RECEIVED BY EXSITE COMMUNICATIONS LIMITED AFTER THE INITIAL TERM, THE SERVICE SHALL CONTINUE AND THE CLIENT WILL CONTINUE TO BE RESPONSIBLE FOR PAYMENT OF MANAGEMENT FEES.

The client is responsible for all content on their website.

exSite Communications Limited reserves the right to change its charges and pricing, and that this will apply to any service provision already in place. The client will be notified in advance of the effective date of the change either by email or by post.
